Waiver of Liability, Terms and Conditions

I, the undersigned parent or legal guardian of the child(ren) attending a My Gym birthday party, understand that participation in gym activities involves physical movement and interaction with others and carries inherent risks in serious injury, including but not limited to:
a) Physical risks including loss on control, collisions, falls, equipment contact, sprains, strains, fractures, concussions, head injuries, equipment malfunction or failure, misjudgment on capabilities, improper technique, and other serious injuries that may result in permanent disability or death
b) Premises and environmental risks, including defects in premises or facilities, slipper or uneven surfaces, obstacles, temperature variations, inadequate lighting, noise levels, crowded conditions and the condition of floors, walls, doors and other facility features.
In the event of an emergency involving me or my child/ward, I authorize MY GYM LANGLEY staff to secure emergency medical treatment on behalf of myself or my child/ward, including transportation to a medical facility, and I consent to such treatment.

I understand and agree that I am financially responsible for any costs associated with such medical treatment, transportation, and related expenses incurred as a result of injuries sustained during the party activities. I understand that MY GYM LANGLEY is not required to provide medical insurance coverage for participants , and I am responsible for ensuring that I have adequate personal medical and accident insurance coverage.


I hereby give consent for my child(ren)’s participation and agree to release and hold harmless MY GYM Enterprises, its franchisees, parents, subsidiaries, affiliates, and all owners, officers, directors, agents, employees, and representatives from any and all liability for injuries or damages arising out of participation in the birthday party.


Promotional, Website, and Social Media Notice: I hereby give MY GYM, and MY GYM ENTERPRISES, permission for the copyright and use of photos or videos they may capture of my child or me for use in various areas, including but not limited to the MY GYM website, training materials, promotional materials, marketing materials, and online. I hereby give MY GYM, and MY GYM ENTERPRISES, further permission for the copyright and use of these photos or videos on MY GYM’S social media websites.
 
This agreement is governed by the laws of Province of British Columbia, and any disputes arising from or related to this agreement shall be resolved in the courts of British Columbia. I have carefully read and fully understood this entire agreement, including all risks disclosed and all rights I am waiving to the extent permitted by law, and sign it freely and voluntarily without any inducement or coercion.
